  • Is It Cost Effective To Use Legal Practices Or Debt Collection Agencies When A Small Organisation Is Chasing settlement Of An Overdue Invoice With A Large Organisation?

Posted on July 10th, 2010 admin No comments

When a small business has completed a project for a larger business and presented their bill as usual, it could come as a surprise if they are left waiting for completion after the final completion date. In the current financial downturn, many companies have gone into administration while others are fighting to stay afloat, so this unpaid bill could be very important to the small business and one they will need to have paid soon. If the small business is indeed short of money and has not had a satisfactory response when they got hold of the large business, then they could well decide that their next move will be Debt Collection.

The Debt Collection market seems to have mushroomed since the financial downturn started and this could now be something of a minefield for a relative newcomer, which the small business could well be. While in the typical Debt Collection area of lawyers and Debt Collection Agencies there are probably a lot of reliable and ethical ones, it could be the case that some newer entrants could not be so ethical. This could be displayed in the shape of unprofessional Debt Collection practices being brought to bear such as threatening behaviour or intimidation, or rising fees perhaps. It will be unlikely that the small business will be able to tell the good from the bad when evaluating lawyers and Debt Collection Agencies, but in any event the usual charges that both lawyers and Debt Collection Agencies make are in the range of 10% to 20% and couldbe more of the bill value. For this the small business will get the Debt Collection procedure taken out of their hands and ran by a team of experienced people. The small business will need to realise that the solicitor or Debt Collection Agencies will be acting in the name of the small business and so the commercial relationship that they have built with the large business could be at risk. The other Debt Collection option is Debt Collection Software, which allows the small business to take on the Debt Collection procedure in-house and so to be in control of how the Debt Collection procedure is handled.

When it comes to cost, Debt Collection Software could seem attractive when for around ?40 the small business can buy a decent Debt Collection Software application and this being a one-off purchase it can be used for any future Debt Collection projects at no extra cost. However the small business will no doubt realise that they must provide the resources and time to run the Debt Collection Software and also they could well have a learning curve to negotiate as they could not have any experience in Debt Collection. When they evaluate Debt Collection Software systems the small business should look at the documentation sets since they could be the main source of information. The documentation set should give the employees in the small business a good grasp of how the Debt Collection procedure works and the importance of composing good quality Debt Collection letters. For composing the Debt Collection letters it would be very useful if the documentation set could provide details of current Acts of Parliament that the small business could use and also any useful sentences that Debt Collection Agencies use. In this way the small business has a good chance of getting the Debt Collection Software to pay dividends in getting the large business to pay the bill, without damaging the commercial relationship.
